The First Secretary of State, in exercise of the powers conferred by sections 22 and 105 of the Local Government Act 20001, hereby makes the following Regulations:
Citation, commencement and application1

These Regulations may be cited as the Local Authorities (Executive Arrangements) (Access to Information) (Amendment) (England) Regulations 2006 and shall come into force on 1st March 2006.

These Regulations apply in relation to local authorities in England.
Additional rights of access to documents for members of local authorities2
In regulation 17 of the Local Authorities (Executive Arrangements) (Access to Information) (England) Regulations 20002—
a
in paragraphs (1) and (2), for “(3) and (4)”, substitute “(3) to (4)”; and
b
for paragraph (3), substitute—

Paragraphs (1) and (2) do not require a document to be available for inspection if it appears to the proper officer that it discloses exempt information of a description falling within Part 1 of Schedule 12A to the 1972 Act (descriptions of exempt information: England)3.

But paragraphs (1) and (2) do require (despite paragraph (3)) the document to be available for inspection if the information is information of a description for the time being falling within—
a
paragraph 3 of Schedule 12A to the 1972 Act (except to the extent that the information relates to any terms proposed or to be proposed by or to the authority in the course of negotiations for a contract); or
b
paragraph 6 of Schedule 12A to the 1972 Act.
