The Secretary of State makes the following Order in exercise of the powers conferred by section 108(3)(d) of the Clean Neighbourhoods and Environment Act 2005(1).
1.—(1) This Order may be cited as the Clean Neighbourhoods and Environment Act 2005 (Commencement No. 4) Order 2006.
(2) In this Order “the 2005 Act” means the Clean Neighbourhoods and Environment Act 2005.
2. The following provisions of the 2005 Act shall come into force on 7th March 2006—
(a)section 49(1);
(b)section 49(2) for the purpose of enabling regulations to be made by the Secretary of State under section 52(1)(a) of the Environmental Protection Act 1990(2);
(c)section 49(3);
(d)section 49(6) for the purpose of enabling regulations to be made by the Secretary of State under section 52(3)(a) of the Environmental Protection Act 1990.
3. The following provisions of the 2005 Act shall come into force on 6 April 2006—
(a)section 49(4);
(b)section 49(2) and (6), in so far as not already in force;
(c)section 49(8) for the purpose of enabling guidance to be given by the Secretary of State under section 52(8A)(a) of the Environmental Protection Act 1990;
(d)section 49(9);
(e)the following provisions of paragraph 3 of Schedule 4—
(i)sub-paragraphs (1) to (4); and
(ii)sub-paragraph (6) for the purposes of amendments to section 52(1) and (3) of the Environmental Protection Act 1990,
and section 106 in so far as it relates to those provisions.

This commencement Order brings into force section 49 (other than section 49(5) and (7)) of the Clean Neighbourhoods and Environment Act 2005 (2005 c. 16) (“the Act”). Section 49 deals with payments by waste disposal and waste collection authorities for recycling and disposal of waste.
Article 2 brings into force on 7th March 2006 certain provisions in section 49 of the Act which confer powers on the Secretary of State to make Orders and Regulations.
Article 3 brings into force on 6th April 2006 the remainder of section 49 of the Act (other than section 49(5) and (7)) in so far as not already in force and paragraph 3 of Schedule 4, other than the provisions in this paragraph dealing with amendments to sections 52(2) and (4) of the Environmental Protection Act 1990 (c. 93).
