The Secretary of State as respects England and the National Assembly for Wales as respects Wales are designated(1) for the purpose of section 2(2) of the European Communities Act 1972(2) in respect of measures relating to the prevention, reduction and elimination of pollution caused by waste.

They make the following Regulations in exercise of the powers conferred on them by that section, and sections 33(3), 34(5), and 35(6) of the Environmental Protection Act 1990(3), having had regard in particular in exercising their powers under section 33(3) of that Act to the matters specified in section 33(4) of that Act:

1972 c.68. Section 2(2) was amended by the Scotland Act 1998 (c.46), Schedule 8, paragraph 15(3). The functions conferred upon the Minister of the Crown under section 2(2) of the European Communities Act 1972, insofar as within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).

1990 c.43. The functions of the Secretary of State under sections 33(3), 34(5) and 35(6), insofar as exercisable in relation to Wales, were transferred to the National Assembly for Wales by virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), article 2 and Schedule 1.
