The Outer Space Act 1986 (Bermuda) Order 2006

Coming into force in accordance with Article 1

At the Court at Buckingham Palace, the 14th day of November 2006

The Queen’s Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred upon Her by section 15(6) of the Outer Space Act 1986(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered as follows:

1.  This Order may be cited as the Outer Space Act 1986 (Bermuda) Order 2006 and shall come into force one month after the date on which it is made.

2.  In this Order “the Act” means the Outer Space Act 1986.

3.—(1) The Act shall extend to Bermuda subject to the exceptions and modifications specified in the Schedule to this Order.

(2) For the purposes of construing the Act as so extended as part of the law of Bermuda any reference to the Act is a reference to the Act as it has effect in Bermuda.

Article 3

SCHEDULEEXCEPTIONS AND MODIFICATIONS IN THE EXTENSION OF THE OUTER SPACE ACT 1986 TO BERMUDA

1.  In Section 1 for the words “the United Kingdom” there shall be substituted the word “Bermuda”.

2.  In Section 2—

(a)in subsection (1) for the words “Scottish firms, and bodies incorporated under the law of any part of the United Kingdom” there shall be substituted the words “and bodies incorporated under the law of Bermuda”; and

(b)subsection (3) shall be omitted.

3.  In section 3—

(a)in subsections (1) and (3) for the words “Secretary of State” there shall be substituted the word “Governor acting in his discretion”; and

(b)subsection (4) shall be omitted.

4.  In section 4—

(a)in subsection (1) for the words “Secretary of State” there shall be substituted the word “Governor acting in his discretion”;

(b)in subsection (2)(c) after the words “United Kingdom” there shall be added the words “or the security of Bermuda”; and

(c)in subsection (3) for the words “Secretary of State” where they first appear there shall be substituted the word “Governor acting in his discretion” and in paragraph (d) the words “to the Secretary of State” shall be omitted.

5.  In section 5—

(a)in subsections (1) and (2)(a), (b), (c), (d) and (g) for the words “Secretary of State” there shall be substituted the word “Governor acting in his discretion”;

(b)in subsection (2)(e)(iv) after the words “United Kingdom” there shall be added the words “or the security of Bermuda”; and

(c)in subsection (2)(f) there shall be substituted for the words “United Kingdom” the word “Bermuda”.

6.  In Section 6—

(a)in subsections (1) and (2) for the words “Secretary of State” there shall be substituted the word “Governor acting in his discretion”; and

(b)in subsection (2)(b) before the words “national security” there shall be added the word “the” and after the words “national security” there shall be added the words “of the United Kingdom or the security of Bermuda”.

7.  In Section 7—

(a)In subsections (1) and (2) for the words “Secretary of State” there shall be substituted the word “Governor acting in his discretion”; and

(b)In subsection (3) for the words “the Secretary of State may prescribe” there shall be substituted the words “may be prescribed”.

8.  In Section 8—

(a)In subsection (1) for the words “Secretary of State” there shall be substituted the word “Governor acting in his discretion”; and

(b)in subsection (3) for the words “Secretary of State” there shall be substituted the words “Attorney General”, and the words “or, in Scotland, by interdict or by order under section 91 of the Court of Session Act 1868” shall be omitted.

9.  In Section 9—

(a)in subsection (1) for the words “Secretary of State” there shall be substituted the word “Governor acting in his discretion”; and

(b)subsection (6) shall be omitted.

10.  In section 10(2)(b) for the words “Secretary of State” there shall be substituted the word “Governor acting in his discretion”.

11.  In Section 11—

(a)in subsection (1) for the words “Secretary of State” there shall be substituted the word “Governor acting in his discretion”; and

(b)subsection (2) shall be omitted.

12.  In section 12—

(a)for subsection (2) there shall substituted the following:—

(2) A person who commits an offence is liable on conviction—

(a)on indictment, to a fine that is in the discretion of the court; and

(b)by a court of summary jurisdiction to a fine not exceeding $25,000.

(b)in subsection (4) for the words “United Kingdom” there shall be substituted the word “Bermuda”; and

(c)in subsection (6) for the words “United Kingdom” there shall be substituted the word “Bermuda”.

13.  In section 13(1) the definition of “British overseas territory” shall be omitted.

14.  In section 14, the definition of “British overseas territory” shall be omitted.

15.  In section 15, subsections (5) and (6) shall be omitted.

This Order extends the Outer Space Act 1986 to Bermuda subject to specified exceptions and modifications.
