NATIONAL LOTTERY

The National Lottery Distributors Dissolution Order 2006

Coming into force in accordance with Article 1

The Secretary of State makes the following Order in exercise of the powers conferred by section 43B of, paragraph 1 of Schedule 5, paragraph 2 of Schedule 6 and paragraph 1 of Schedule 6A to, the National Lottery etc. Act 1993(1) and section 16 of the National Lottery Act 2006(2).

In accordance with section 17(8)(b) of the National Lottery Act 2006, the Secretary of State is satisfied that, in relation to the dissolution of the National Lottery Charities Board, the Millennium Commission and the New Opportunities Fund and the transfer of their rights and liabilities to the Big Lottery Fund, sufficient notice has been given to enable compliance with any applicable requirement of the Transfer of Undertakings (Protection of Employment) Regulations 2006(3).

Citation, commencement and interpretation

1.—(1) This Order may be cited as the National Lottery Distributors Dissolution Order 2006.

(2) This Order shall come into force only if the Prescribed Expenditure Order is made, and shall do so on the day that Order comes into force(4).

(3) If the Prescribed Expenditure Order is not made before 31st December 2006, this Order is revoked with effect from that date.

(4) In this article “the Prescribed Expenditure Order” means the Big Lottery Fund (Prescribed Expenditure) Order 2006 laid in draft before Parliament on 11th October 2006.

Dissolution

2.  The National Lottery Charities Board(5), the Millennium Commission(6) and the New Opportunities Fund(7) shall cease to exist on the day this Order comes into force.

Revocation

3.  The Orders listed in the Schedule are hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order dissolves the National Lottery Charities Board (also known as the Community Fund), the Millennium Commission and the New Opportunities Fund on the date that the Big Lottery Fund (Prescribed Expenditure) Order 2006 comes into force. Article 1 of that Order, which was laid in draft before Parliament on 11th October 2006, provides for it to come into force on whichever is the later of 1st December 2006 or the day after the day on which it is made. The Big Lottery Fund, established by section 14 of the National Lottery Act 2006, is the successor body of these three lottery distributors. This Order also revokes several statutory instruments which related to the dissolved distributors.

S.I. 2006/246. Section 17(8)(b) of the National Lottery Act 2006 refers to the Transfer of Undertakings (Protection of Employment) Regulations 1981 (No. 1794) which were revoked by S.I. 2006/246. The reference is treated as a reference to S.I. 2006/246 by virtue of section 17(2)(b) of the Interpretation Act 1978 (c.30).

Article 1 provides that the Order shall come into force on 1st December 2006 or the day after the day on which it is made, whichever is the later.
