These Regulations are made in exercise of the powers conferred by sections 91, 96 and 210 of the Education Act 2002(1).

In accordance with subsection (2) of section 96, the Secretary of State has referred a proposal to make these Regulations to the Qualifications and Curriculum Authority (“QCA”)(2) and in accordance with subsection (3) of that section, the QCA has given notice of the proposal to the associations, bodies, organisations, and persons referred to in that subsection and given them a reasonable opportunity of submitting evidence and representations as to the issues arising;

In accordance with directions given by the Secretary of State under subsection (2) of section 96, the QCA has submitted its report to the Secretary of State containing the matters referred to in subsection (4) of that section;

After submitting its report to the Secretary of State, the QCA has arranged for it to be published in accordance with subsection (5) of that section;

The Secretary of State has published a draft of these Regulations and sent copies of them to the QCA and all those who were consulted by the QCA in accordance with subsection (6) of section 96, and has allowed a period of not less than one month for the submission of evidence and representations as to the issues arising in accordance with subsection (7) of that section;

Accordingly, the Secretary of State for Education and Skills makes without modification the following Regulations:
