The Secretary of State is designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community.

The Secretary of State makes these Regulations in exercise of the powers conferred on him by that section:

Title, application and commencement

1.—(1) These Regulations may be cited as the Animals and Animal Products (Import and Export) (England) (Amendment) Regulations 2006, and apply in England only.

(2) These Regulations come into force—

(a)for the purposes of regulation 2(3), on 1st August 2006;

(b)for all other purposes, on 1st September 2006.

Amendment to the Animals and Animal Products (Import and Export) (England) Regulations 2006

2.—(1) Amend the Animals and Animal Products (Import and Export) (England) Regulations 2006(3) in accordance with this regulation.

(2) In regulation 1(3)—

(a)in the definition of “Council Directive 90/425/EEC” for “paragraph 4(a)”, substitute “paragraph 5(a)”; and

(b)in the definition of “Council Directive 91/496/EEC” for “paragraph 4(b)”, substitute “paragraph 5(b)”.

(3) In regulation 16(4), for “1st August 2006”, substitute “1st January 2007”.

(4) In regulation 19(9), after “an inspector” add “in the case of sub-paragraphs (a) and (b), and a veterinary inspector in the case of sub-paragraph (c)”.

(5) In regulation 21(3), for “veterinarian”, substitute “veterinary”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Animals and Animal Products (Import and Export) (England) Regulations 2006 (S.I. 2006/1471) (“the principal Regulations”).

Regulation 2(3) amends the principal Regulations to give effect to the extension of the European Union ban under Commission Decision 2005/760/EC (OJ No. L 285, 28.10.2005, p. 52, as amended by Commission Decision 2006/522/EC, OJ No. L 205, 27.7.2006, p. 28) on the import of captive birds from third countries until 1st January 2007.

Regulation 2 of these Regulations also makes minor amendments to other provisions in the principal Regulations.

No regulatory impact assessment has been produced for these Regulations in view of the urgency required to give effect to the extension of the import ban in relation to captive birds, and because the other amendments have no impact on businesses.
