Exclusion of penalty charges for content of pack documents32
Section 168(1)(a) of the 2004 Act does not apply to a breach of a duty under section 155(1) or 159(2) of that Act to the extent that—
a
the content of a pack document, other than the home information pack index and the sale statement, fails to comply with any requirement of these Regulations; and
b
the responsible person believes on reasonable grounds that the document does comply with that requirement.
