Directions fixing the time and place of a hearing14
Before making a direction under rule 12(b) to fix the time and place of a hearing, the Tribunal shall consider—
a
whether the reference should be dealt with as a matter of urgency, in particular considering whether the Regulator has already exercised a regulatory function under the 2004 Act or the 2005 Order, or whether that function may not be exercised until the reference has been finally disposed of; and
b
the convenience of the applicant to the reference in attending or being able to attend a hearing which is to be heard as a matter of urgency at short notice.
