In exercise of the powers conferred on the Secretary of State by sections 485, 489 and 569(4) and (5) of the Education Act 1996(1) the Secretary of State for Education and Skills hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Education (Grants etc.) (Dance and Drama) (England) (Amendment) Regulations 2005 and shall come into force on 12th April 2005.

(2) In these Regulations “the principal Regulations” means the Education (Grants etc.) (Dance and Drama) (England) Regulations 2001(2).

Amendment of regulation 2

2.  In regulation 2 of the principal Regulations (Interpretation) omit the definitions of “Part 1 relevant institution” and “Part 2 relevant institution”.

Amendment of regulation 3

3.  In regulation 3(1) of the principal Regulations (Meaning of “new award student”) omit the words “of a description mentioned in Part II of Schedule 1” and the words “Part 1”.

Amendment of regulation 4

4.  In regulation 4(1) of the principal Regulations (New award students—supplementary) omit the words “Part 1” and the words “in Part 1” wherever they appear.

Amendment of regulation 7

5.—(1) Regulation 7 of the principal Regulations shall be amended in accordance with paragraphs (2) and (3).

(2) For paragraph (2) substitute the following paragraph—

(2) Subject to paragraphs (3) and (4) grant paid under this regulation shall be such amount as the Secretary of State may determine, being not less than the amount specified in the fifth column of the table in Schedule 1 in relation to the institution, multiplied by the number of award students attending the institution during the academic year in question..

(3) In paragraph (4)(a) for the figure of “£1,100” there shall be substituted the figure of “£1,150”.

Amendment to Schedule 2

6.  For Schedule 2 to the principal Regulations substitute the following Schedule–

Explanatory Note

(This note is not part of the Regulations)

These Regulations make amendments to the Education (Grants etc.) (Dance and Drama) (England) Regulations 2001 (the principal Regulations).

A new Schedule 2 to the principal Regulations is substituted which specifies the institutions currently participating in the scheme, reflects changes in the names of some of the institutions and varies the numbers used in calculating the grants to be paid.

The institutions formerly included in Part 2 of what was Schedule 2 no longer participate in the scheme and so the new schedule 2 is not divided into parts. Accordingly regulations 2, 3, 4, 5 and 7 are amended to remove references to Part 1 and Part 2.
