The Secretary of State, in exercise of the powers conferred upon him by section 41(2) and (3) of the British Nationality Act 1981(1), with the consent of the Treasury, hereby makes the following Regulations:
1. These Regulations may be cited as the British Nationality (Fees) (Amendment) Regulations 2005 and shall come into force on 1st April 2005.
2. The British Nationality (Fees) Regulations 2003(2) are amended as follows.
3. For the fees specified for items numbered 1(a) and (b), 2, 3, 4(a) and (b) and 6 in the table in the Schedule to those Regulations (as set out in the left-hand column of the table below), substitute the fees set out in the right-hand column of the table below.

These Regulations amend the British Nationality (Fees) Regulations 2003 with effect from 1st April 2005 to prescribe new fees payable in connection with nationality applications under the British Nationality Act 1981 (“the 1981 Act”) and the British Nationality (Hong Kong) Act 1997 (“the 1997 Act”), and for applications for registration of a declaration of renunciation of citizenship.
The new fee for an application under the 1981 Act (except for an application under section 5) for registration as a British citizen, British overseas territories citizen, British Overseas citizen or British subject is £120 for an adult and £200 for a minor (formerly the fee was £85 for an adult and £144 for a minor). The new fee for an application for naturalisation as a British citizen or British overseas territories citizen under section 6(1) or 18(1) of the 1981 Act is £200 (formerly £150) as is the new fee for an application for naturalisation as a British citizen or British overseas territories citizen under section 6(2) or 18(2) of the 1981 Act (formerly this fee was £146). The new fee for an application for registration as a British citizen under section 1 of the 1997 Act is £120 for an adult and £200 for a minor (formerly the fee was £85 for an adult and £144 for a minor). The new fee payable in respect of the registration of a declaration of renunciation of British citizenship, British overseas territories citizenship, British Overseas citizenship or British subject status is £120 (formerly £81).
1981 c. 61. The powers in section 41(2) and (3) were extended by section 2(3) of the British Nationality (Hong Kong) Act 1997 (c. 20) and section 41(2)(c) was amended by paragraph 5 of Schedule 1 to the Nationality, Immigration and Asylum Act 2002 (c. 41). Functions to be taken into account in fixing fees under section 41(2) are specified in article 3(1) of the Immigration (Application Fees) Order 2005 (S.I. 2005/582).
