The Treasury in exercise of powers conferred on them by sections 349(1)(b), (2) and (3), and 417 (1)(1) of the Financial Services and Markets Act 2000(2) make the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Financial Services and Markets Act 2000 (Disclosure of Confidential Information) (Amendment) Regulations 2005 and shall come into force on 25th November 2005.

Amendment of the Financial Services and Markets Act (Disclosure of Confidential Information) Regulations 2001

2.—(1) The Financial Services and Markets Act 2000 (Disclosure of Confidential Information) Regulations 2001(3) are amended as follows.

(2) In Part 1 of Schedule 1 (disclosure of confidential information whether or not subject to directive restrictions)—

(a)for “The Occupational Pensions Regulatory Authority”, substitute “The Pensions Regulator”;

(b)for “Its functions under: (a) the Pensions Schemes Act 1993, (b) the Pensions Act 1995, or (c) any enactment in force in Northern Ireland corresponding to an enactment referred to in (a) or (b),”, substitute, “Its functions as such”.

(3) In Schedule 2 (disclosure of confidential information not subject to directive restrictions)—

(a)for “The Occupational Pensions Regulatory Authority”, substitute “The Pensions Regulator”;

(b)for “Its functions under the Pension Schemes Act 1993 and the Pensions Act 1995”, substitute “Its functions as such”.

Explanatory Note

(This note is not part of the Order)

These Regulations amend the Financial Services and Markets Act 2000 (Disclosure of Confidential Information) Regulations 2001 (“the principal regulations”), replacing the reference to the Occupational Pensions Regulatory Authority with a reference to the Pensions Regulator. Regulations 2(2)(b) and 2(3)(b) amend the principal regulations in order to set out the functions for which information may be disclosed.
