The Great Yarmouth Outer Harbour (No. 2) Revision Order 2005

Whereas the Great Yarmouth Port Authority has applied for a Harbour Revision Order under section 14 of the Harbours Act 1964(1);

And whereas the Secretary of State is satisfied as mentioned in subsection 2(b) of the said section 14;

Now, therefore, the Secretary of State (being the appropriate Minister under subsection (7) of the said section 14(2)), in exercise of the powers conferred by that section and now vested in him(3) hereby makes the following Order:

Citation and commencement

1.—(1) This Order may be cited as the Great Yarmouth Outer Harbour (No. 2) Revision Order 2005 and shall come into force on 6th October 2005.

(2) This Order shall be included amongst the Orders which may be cited together as the Great Yarmouth Port Authority Acts and Orders 1866 to 2005.

Repeal of enactment

2.  Section 35 (Saving for revenues of Haven) of the Great Yarmouth Outer Harbour Act 1986(4) is hereby repealed.

Explanatory Note

(This note is not part of the Order)

This Order provides for the repeal of section 35 of the Great Yarmouth Outer Harbour Act 1986. This section prohibits the use of ship passenger and goods dues from the existing harbour for the purposes of the construction and operation of the Outer Harbour.

The applicants for the Order are the Great Yarmouth Port Authority.
