The Secretary of State, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to access to the labour market of the United Kingdom, in exercise of the powers conferred upon him by the said section 2(2), hereby makes the following Regulations:

Citation and commencement

1.—(1) These Regulations may be cited as the Accession (Immigration and Worker Registration) (Amendment) Regulations 2005 and shall come into force on 1st October 2005.

(2) Regulation 2 shall not have effect in relation to an application for a registration certificate under regulation 8 of the Accession (Immigration and Worker Registration) Regulations 2004(3) made before 1st October 2005.

2.  In regulation 8(4)(a) of the Accession (Immigration and Worker Registration) Regulations 2004, for “£50” substitute “£70”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Accession (Immigration and Worker Registration) Regulations 2004.

The 2004 Regulations established a worker registration scheme for workers from eight of the States that acceded to the European Union on 1st May 2004. Under that scheme workers from those States who begin working for an employer in the UK on or after 1st May 2004 are generally required to apply, within one month of beginning work, for a registration certificate authorising them to work for that employer. Regulation 8 of the 2004 Regulations sets out the procedure applying to an application for a registration certificate.

Under regulation 8(4) of the 2004 Regulations, an application by a worker who has not previously registered under the worker registration scheme must be accompanied by a registration fee of £50. The registration fee is intended to cover the administrative costs of registration. These Regulations increase that fee to £70 in relation to applications made on or after 1st October 2005.
