The Queen’s Most Excellent Majesty in Council

Whereas a draft of this Order has, in accordance with section 120(5) of the Courts and Legal Services Act 1990(1), been laid before and approved by each House of Parliament:

Now, therefore, Her Majesty, in pursuance of a recommendation made by the Secretary of State(2) and in exercise of the powers conferred on Her by section 29 of and Part 1 of Schedule 4 to the Courts and Legal Services Act 1990(3), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

Citation and commencement

1.  This Order may be cited as the Institute of Trade Mark Attorneys Order 2005 and shall come into force on 1st April 2005.

Authorised body

2.  The Institute of Trade Mark Attorneys is hereby designated as an authorised body for the purposes of sections 27 and 28 of the Courts and Legal Services Act 1990.

Explanatory Note

(This note is not part of the Order)

This Order designates the Institute of Trade Mark Attorneys as an authorised body for the purposes of sections 27 and 28 of the Courts and Legal Services Act 1990, under which authorised bodies may grant rights of audience and rights to conduct litigation.

Power to make recommendations transferred from the Lord Chancellor to the Secretary of State by the Secretary of State for Constitutional Affairs Order 2003 (S.I.2003/1887).
