43. Any difference arising between Merseytravel and a specified undertaker under this Schedule (other than a difference as to its meaning or construction) shall be determined by arbitration in the manner provided by article 77 of this Order and in determining any difference under this Schedule the arbitrator may, if he thinks fit, require Merseytravel to execute any temporary or other works so as to avoid, so far as may be reasonably possible, interference with the use of any apparatus.
