The Langstone (Pilotage) Harbour Revision Order 2005

Whereas the Langstone Harbour Board have applied for a harbour revision order under section 14 of the Harbours Act 1964(1) and in accordance with section 7(5) of the Pilotage Act 1987(2);

And whereas no objections to the application have been made in accordance with paragraph 10(2)(f) of Schedule 3 to the said Act;

Now, therefore, the Secretary of State for Transport (being the appropriate Minister under subsection (7) of the said section 14(3)), in exercise of the power conferred by that section and now vested in him(4), hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Langstone (Pilotage) Harbour Revision Order 2005 and shall come into force on 1st April 2005.

Interpretation

2.  In this Order—

“the Authority” means the Langstone Harbour Board as constituted by Part II of the Pier and Harbour Order (Langstone Harbour) Confirmation Act 1962(5);

“the Harbour” means all of Langstone Harbour lying within the limits described in section 7 of the Pier and Harbour (Langstone Harbour) Confirmation Act 1962(6); and

“signed plan” means the plan prepared in triplicate, signed by the Head of Ports Division in the Department for Transport and marked “The Langstone (Pilotage) Harbour Revision Order 2005”, two copies of which have been deposited at that Department and one copy of which has been deposited at the offices of the Authority situated at Ferry Road, Hayling Island, PO11 0DG.

Extension of limits of jurisdiction for the purpose of Pilotage

3.  The limits within which the Authority shall have jurisdiction for the purposes of pilotage under Part I of the Pilotage Act 1987 shall include (in addition to the Harbour) the area outlined in red on the signed plan, being so much of the area of the Solent outside the Harbour as lies to the west of Longitude 001° 00.0'W, to the north of a line bearing 090° from Saint Helen’s Fort (Latitude 50° 42.28'N. Longitude 001° 04.96'W) and to the east of a line bearing 000° from Saint Helen’s Fort to latitude 50° 44.0'N, thence to the east end of the Eastney Point outfall (Latitude 50° 47.2'N. Longitude 001° 01.6'W).

Explanatory Note

(This note is not part of the Order)

By virtue of section 7(5) of the Pilotage Act 1987 a direction given by a competent harbour authority for the purposes of making pilotage compulsory for ships navigating in a specified area shall not apply to any area which is outside the authority’s harbour unless the limits of jurisdiction of the Authority for pilotage purposes have been extended to cover that area.

This Order accordingly extends the limits of jurisdiction of the Langstone Harbour Board for pilotage purposes under Part I of the Pilotage Act 1987 so as to include an area outside the port in respect of which the authority considers that pilotage should be compulsory.

The applicant for this Order is Langstone Harbour Board.

The signed plan indicating the extended limits of jurisdiction is available for inspection between 9.00 am and 4.00 pm Monday to Friday at the Harbour Office, Ferry Road, Hayling Island, Hants P011 0DG.
