This Order brings section 223 of the Housing Act 2004 into force in England on 27th April 2005. Section 223 amends section 167(2)(d) of the Housing Act 1996 which provides that a local housing authority’s scheme for allocating housing accommodation must be framed so as to secure that reasonable preference is given to people who need to move on medical or welfare grounds. The amendment provides that “medical or welfare grounds” include grounds relating to a disability.
