The Secretary of State, being a Minister designated for the purposes of section 2(2) of the European Communities Act 1972(1) in relation to the notification and control of substances and the control of the import and export of goods, in exercise of the powers conferred upon him by that section, hereby makes the following Regulations:
1. These Regulations may be cited as the Controlled Drugs (Substances Useful for Manufacture) (Intra-Community Trade) (Amendment) Regulations 2004 and shall come into force on 13th April 2004.
2.—(1) The Controlled Drugs (Substances Useful for Manufacture) (Intra-Community Trade) Regulations 1993(2) shall be amended as follows.
(2) In Category 2 of Schedule 1, after “Piperidine” there shall be inserted “Potassium permanganate”.
(3) For the table in Schedule 2 (specified quantities of scheduled substances in Category 2 of Schedule 1) there shall be substituted the table in the Schedule to these Regulations.

These Regulations amend the Controlled Drugs (Substances Useful for Manufacture) (Intra-Community Trade) Regulations 1993 (“the Regulations”) in accordance with Council Directive 92/109/EEC (as amended by Commission Directives 2003/101/EC and 2001/8/EC). The substance potassium permanganate is added to Category 2 of Schedule 1, which specifies scheduled substances for the purpose of regulation 2 of the Regulations, with regulation 2 defining the term “scheduled substance”. The table in the Schedule replaces the table in Schedule 2 (specified quantities of scheduled substances in Category 2 of Schedule 1) to the Regulations. The corresponding quantity for the substance acetic anhydride is amended from 20 litres to 100 litres and the substance potassium permanganate is added to the table with the corresponding quantity of 100 kilogrammes.
