The Secretary of State, in exercise of the powers conferred upon her by section 10 of the Animal Health Act 1981(1) makes the following Order:
1. This Order may be cited as the Pet Travel Scheme (Pilot Arrangements) (England) (Amendment) Order 2004; it applies only to England and comes into force on 13th April 2004.
2.—(1) The Pet Travel Scheme (Pilot Arrangements) (England) Order 1999(2) shall be amended in accordance with this article.
(2) For paragraph 5 to 8 of Schedule 6 there shall be substituted the following paragraphs—
5. An animal must be transported to England by a carrier approved under article 8.
6.—(1) On arrival in England, the carrier shall check the microchip required under paragraph 2 of this Schedule and the documentation required under paragraph 4 of this Schedule in the manner specified in article 9(1) (and in the case of a cat arriving from Australia the certificate relating to the Hendra virus required under paragraph 1 of this Schedule), and in the place and manner specified in its approval.
(2) Subject to the provisions of sub-paragraph (3), the carrier shall comply with the provisions of articles 9(4) and 9(5).
(3) If an animal arrives by sea, the carrier shall ensure it is taken into quarantine in accordance with article 9(4)(b) unless satisfied that throughout the voyage it has had no contact with any other animal and has not been put ashore at any point.”
3. In article 5A of The Rabies (Importation of Dogs, Cats and Other Mammals) Order 1974(3) paragraph (e) shall be deleted.

This Order amends the Pet Travel Scheme (Pilot Arrangements) (England) Order 1999. It removes the requirements that animals from most qualifying non-European countries or territories travel to England by air and are sealed in a container during the journey.
The Order also makes a consequential amendment to the Rabies (Importation of Dogs, Cats and Other Mammals) Order 1974 to allow the Secretary of State to release animals meeting certain conditions from quarantine by licence without being satisfied that they arrived in England in a sealed container.
No Regulatory Impact Assessment has been prepared in respect of this Order.
1981 c. 22. Functions conferred under the 1981 Act on “the Ministers” (as defined in section 86 of that Act) were transferred, so far as exercisable by the Secretaries of State for Scotland and Wales, to the Minister of Agriculture, Fisheries and Food by the Transfer of Functions (Agriculture and Food) Order 1999 (S.I. 1999/3141) and were then further transferred to the Secretary of State by the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I. 2002/794).
