The Criminal Justice and Court Services Act 2000 (Commencement No. 12) Order 2004

The Secretary of State, in exercise of the powers conferred upon him by section 80 of the Criminal Justice and Court Services Act 2000(1) hereby makes the following Order:

1.  This Order may be cited as the Criminal Justice and Court Services Act 2000 (Commencement No. 12) Order 2004.

2.  Section 57 of the Criminal Justice and Court Services Act 2000(2) (testing persons in police detention) shall come into force on 1st April 2004 within the following police areas(3):

(a)Cambridgeshire;

(b)Leicestershire;

(c)Northumbria; and

(d)West Midlands.

Explanatory Note

(This note is not part of the Order)

This Order applies to England and Wales. It brings into force on 1st April 2004 section 57 of the Criminal Justice and Court Services Act 2000 (drug testing persons in police detention) within the Cambridgeshire, Leicestershire, Northumbria and West Midlands police areas. The provision has already been commenced in the police areas of Nottinghamshire, Staffordshire and the metropolitan police district by virtue of S.I. 2001/2232, the police areas of Bedfordshire, Devon and Cornwall, Lancashire, Merseyside, South Yorkshire and North Wales by virtue of S.I. 2002/1149, the police areas of Avon and Somerset, Greater Manchester, Thames Valley and West Yorkshire by virtue of S.I. 2002/1862 and the police areas of Cleveland and Humber by virtue of S.I. 2003/709.

The term “police area” has the meaning ascribed to it in section 101 of the Police Act 1996 (c. 16) by virtue of Schedule 1 to the Interpretation Act 1978 (c. 30).
