Construction Contracts (England and Wales) Exclusion Order 1998

26.  After article 3 of the Construction Contracts (England and Wales) Exclusion Order 1998(1) (agreements under statute), there is inserted—

“Other Agreements

3A.— (1) A construction contract is excluded from the operation of Part II if it is an externally financed development agreement entered into by an NHS foundation trust.

(2) In this article “externally financed development agreement” has the same meaning as in section 1 of the National Health Service (Private Finance) Act 1997 reading references in subsections (3) and (5) of that section to the trust as references to an NHS foundation trust.”.
