The Secretary of State for Transport makes this Order in exercise of powers conferred by section 10 of the Highways Act 1980(1) and now vested in him(2), and of all other powers enabling him in that behalf:-

1.  This Order may be cited as the A4097 Trunk Road (M42 Junction 9, Dunton Interchange to M6 Toll Slip Road, Warwickshire) Order 2004 and shall come into force on 20th August 2004.

2.  In this Order—

(i)all measurements of distance are measured along the route of the relevant highway;

(ii)the centre line of the new trunk road is indicated by a heavy black line on the plan numbered HA 10/TD/009, marked “The A4097 Trunk Road (M42 Junction 9, Dunton Interchange to M6 Toll Slip Road, Warwickshire) Order 2004” signed by authority of the Secretary of State for Transport and deposited at the ODPM - DfT, Records Management Branch, Floor 13 (IMD) Ashdown House, St Leonards on Sea, Hastings, East Sussex, TN37 7GA;

3.  The length of the trunk road described in the Schedule to this Order shall become a trunk road from the date on which this Order comes into force.

SCHEDULELENGTH OF HIGHWAY BECOMING A TRUNK ROAD

The length of highway becoming a trunk road is:

(i)the A4097 from its junction with M42 (M42 Junction 9, Dunton Interchange) to its roundabout junction with the on-slip to M6 Toll northbound carriageway, and including the circulatory carriageway of that roundabout.
