1. In section 7(8) of the Opencast Coal Act 1958 (definitions etc. for the purposes of section 7)(1), in the definition of “statutory water undertakers”, in paragraph (ii), for the words from “a water authority” to the end substitute “Scottish Water”.
Section 7(8) was substituted by the Coal Industry Act 1994 (c. 21), section 52(2) and Schedule 8, paragraph 4(c) and was amended by the Environment Act 1995 (c. 25), section 120(1) and Schedule 22, paragraph 5(1) and by the Planning (Consequential Provisions) (Scotland) Act 1997 (c. 11), section 4 and Schedule 2, paragraph 5(1).
