Whereas, following the referral to it of a proposal by the Secretary of State in accordance with subsection (2) of section 96 of the Education Act 2002(1), the Qualifications and Curriculum Authority (“QCA”)(2) has, in accordance with subsection (3) of that section, given notice thereof to the bodies and persons referred to in that subsection and given them a reasonable opportunity of submitting evidence and representations as to the issues arising;

And whereas, in accordance with directions given by the Secretary of State under the said subsection (2), the QCA has submitted its report to the Secretary of State in accordance with subsection (4) of the said section 96;

And whereas the QCA has, after submitting its report to the Secretary of State, arranged for it to be published in accordance with subsection (5) of that section;

And whereas the Secretary of State has published a draft of the Order and sent copies of it to the QCA and all those who were consulted by the QCA, and has allowed a period of not less than one month for the submission of evidence and representations as to the issues arising in accordance with subsections (6) and (7) of that section;

Now therefore the Secretary of State for Education and Skills, in exercise of the powers conferred on the Secretary of State by sections 87(3)(a) and (b), 87(5) and 210 of the Education Act 2002, hereby makes with modification the following Order:

Citation, commencement, interpretation and application

1.—(1) This Order may be cited as the Education (National Curriculum) (Attainment Targets and Programmes of Study in Science in respect of the First, Second, Third and Fourth Key Stages) (England) (No.2) Order 2004 and shall come into force on 1st August 2006, except for article 2(2) which shall come into force on 1st August 2004.

(2) In this Order “the Document” means the Document published by the Department for Education and Skills and the QCA entitled “Science, the National Curriculum for England, Key Stages 1-4”(3).

(3) This Order applies only to pupils in the first, second, third and fourth key stages at–

(a)a community, foundation or voluntary school; or

(b)a community or foundation special school not established in a hospital,

in England.

Revocation

2.—(1) The Education (National Curriculum) (Attainment Targets and Programmes of Study in Science) (England) Order 2000(4) is hereby revoked.

(2) The Education (National Curriculum) (Attainment Targets and Programmes of Study in Science in respect of the First, Second, Third and Fourth Key Stages (England) Order 2004(5) is hereby revoked.

Specification of attainment targets and programmes of study

3.  It is hereby directed that the provisions relating to attainment targets and programmes of study set out in the Document shall have effect for the purposes of specifying attainment targets and programmes of study in relation to science.

Explanatory Note

(This note is not part of the Order)

This Order provides for the attainment targets and programmes of study set out in the document published by the Department for Education and Skills and the QCA “Science, the National Curriculum for England, Key Stages 1-4” (ISBN 1-84478-182-8; order reference DfES/0303/2004) to have effect for the purposes of specifying those elements of the National Curriculum in science for pupils in the first, second, third and fourth key stages at schools in England.

This Order replaces the Education (National Curriculum) (Attainment Targets and Programmes of Study in Science) (England) Order 2000 which is revoked.

This Order is made in consequence of a defect in the Education (National Curriculum) (Attainment Targets and Programmes for Study in Science in respect of the First, Second and Third and Fourth Key Stages) (England) Order 2004 (S.I. 2004/1217) which is revoked by this Order. This Order will be issued free of charge to all known recipients of S.I 2004/1217.
