The First Secretary of State, in exercise of the powers conferred upon him by section 153(4) of the Environmental Protection Act 1990(1), hereby makes the following Order:
1. This Order may be cited as the Financial Assistance for Environmental Purposes (England) Order 2003 and shall come into force on 7th April 2003.
2. In section 153(1) of the Environmental Protection Act 1990(2) (purposes for which financial assistance may be given), after paragraph (qq)(3) there shall be inserted—
“(rr)the Commission for Architecture and the Built Environment, in respect of its activities in England in so far as they relate to the protection, improvement or better understanding of the environment.”

This Order varies section 153(1) of the Environmental Protection Act 1990. It enables the Secretary of State (with the consent of the Treasury) to give financial assistance to, or for the purposes of, the Commission for Architecture and the Built Environment, in respect of its activities in England in so far as they relate to the protection, improvement or better understanding of the environment.
1990 c. 43; the relevant functions of the Secretary of State in so far as they relate to Scotland, were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). In relation to Wales, the Secretary of State has concurrent powers with the National Assembly for Wales (see article 2 of, and the entry relating to the Environmental Protection Act 1990 in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672)).
