The Secretary of State, in exercise of the power conferred upon her by section 9(5) and (8) of the Sustainable Energy Act 2003(1), hereby makes the following Order:
1. This Order may be cited as the Sustainable Energy Act 2003 (Commencement No.1) Order 2003.
2. Section 5 of the Sustainable Energy Act 2003(1) shall come into force on 28th November 2003.

This Order brings into force on the 28th November 2003 section 5 of the Sustainable Energy Act 2003.
Section 5, which applies to England and Wales, requires the Secretary of State before the end of 2003 to make a statement specifying at least one CHP target and the period to which the target relates.
