The Secretary of State, in exercise of the powers conferred upon her by section 153(4) of the Environmental Protection Act 1990(1), hereby makes the following Order:
1990 c. 43. The relevant functions of the Secretary of State, insofar as they relate to Scotland, were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). In relation to Wales, whilst the Secretary of State retains the power to act under section 153 of the Environmental Protection Act 1990, save insofar as her functions under that section conduce to the protection, improvement or better understanding of the environment of, or any part of, Wales, in which case those functions are to be exercised concurrently with the National Assembly for Wales (see article 2 of, and the entry relating to the Environmental Protection Act 1990 in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672)), the UK Environment for Europe Fund does not support any activities in Wales (or any other part of the United Kingdom).
