In exercise of the powers conferred on the Secretary of State by section 214 of the Education Act 2002(1), the Secretary of State for Education and Skills hereby makes the following Regulations:

Citation, commencement and application

1.  These Regulations may be cited as the Education Act 2002 (School Teachers) (Consequential Amendments, etc) (England) Regulations 2003 and shall come into force on 1st September 2003.

2.  These Regulations apply in relation to England.

Consequential amendments, etc

3.  The General Teaching Council for England (Additional Functions) Order 2001(2) is hereby revoked.

4.—(1) The Further Education Teachers' Qualifications (England) Regulations 2001(3) are amended as follows.

(2) In regulation 2 omit the definition of “1999 Regulations qualification” and insert the following definition at the appropriate point in alphabetical order —

“school teachers' qualification” means a qualification such that the holder is a qualified teacher within the meaning of regulation 5 of the Education (School Teachers' Qualifications) (England) Regulations 2003;.

(3) In regulations 3(2) and (3), substitute the following sub-paragraph for sub-paragraph (a) —

(a)a school teachers' qualification;.

(4) Omit regulation 5.

5.—(1) The Education (Fast Track Bursaries and Grants) (England) Regulations 2001(4) are amended as follows.

(2) In regulation 2(1), substitute the following definition for the definition of “qualified teacher”—

“qualified teacher” means a person who satisfies requirements specified in regulations made under section 132 of the Education Act 2002;.

(3) In regulation 5(2), substitute the following sub-paragraph for sub-paragraph (b)—

(b)fails to qualify as a teacher in accordance with the Education (School Teachers' Qualifications) (England) Regulations 2003;.

6.—(1) The General Teaching Council for England (Deduction of Fees) Regulations 2001(5) are amended as follows.

(2) In regulation 3 substitute the following for paragraph (b)—

(b)required to be registered under section 134(1) of the Education Act 2002,.

(3) In regulation 6(1) substitute “to be registered under section 134(1) of the Education Act 2002” for the words “as a consequence” to the end.

Explanatory Note

(This note is not part of the Regulations)

These regulations amend and update specific references in three sets of regulations in order to take account of changes in the law concerning teachers' work, qualifications and registration made by sections 132, 133 and 134 of the Education Act 2002.

In addition the General Teaching Council for England (Additional Functions) Order 2001 (S.I. 2001/1214) is revoked because the functions conferred by that Order are no longer exercisable by the GTCE following the changes mentioned above.

The following regulations are amended —
