5. In article 4 —
(a)omit “and” at the end of paragraph (c); and
(b)at the end of paragraph (d) insert “; and” and the following paragraph —
“(e)an independent school in respect of which proposals under section 28 of the School Standards and Framework Act 1998(1) have been published, have been approved under paragraph 3 of Schedule 6 to that Act and are required to be implemented by virtue of paragraph 5(1) of that Schedule.”.
