Interpretation

3.—(1) In these Regulations:

“the 1998 Act” means the School Standards and Framework Act 1998(1);

“the 2002 Act” means the Education Act 2002;

“the Constitution Regulations” means the School Governance (Constitution) (England) Regulations 2003(2);

“associate member” has the meaning given by regulation 11 of the Constitution Regulations;

“clerk” means the person appointed as clerk to the governing body or, as the case may be, to a committee of the governing body;

“pupil” has the meaning given by section 3 of the Education Act 1996(3).

(2) Any reference in these Regulations to—

(a)a committee is a reference to a committee established by the governing body to which the governing body has delegated any of its statutory functions;

(b)a governing body or to the governing body of a school(4) is a reference to the governing body of a school to which the provision applies, and any reference to a governor is a reference to a member of such a governing body;

(c)the local education authority is to the local education authority that maintains any school to which the provision applies; and

(d)a school is a reference to a maintained school within the meaning of section 39(1) of the 2002 Act.

In accordance with section 24(6) of the 2002 Act, any reference to the governing body of a school is to be construed in relation to a federated school as a reference to the governing body of the federation.
