The Secretary of State for Health, in exercise of the powers conferred on him by section 1(1) and (3) to (5) of the Adoption (Intercountry Aspects) Act 1999(1) and sections 9(2) and (3), 17 and 67(5) of the Adoption Act 1976(2), and of all other powers enabling him in that behalf, after consultation with the National Assembly for Wales(3), hereby makes the following regulations:
1999 c. 18. Section 1 of the Adoption (Intercountry Aspects) Act 1999 (“the 1999 Act”) enables the Secretary of State to make regulations to give effect to the Convention on Protection of Children and Co-operation in respect of Intercountry Adoption, concluded at the Hague on 29 May 1993 (“the Convention”).
1976 c. 36. The functions of the Secretary of State under section 9 of the Adoption Act 1976 (“the 1976 Act”) have been transferred to the National Assembly for Wales under S.I. 1999/692. However, the effect of section 1(6) of the 1999 Act is that the Secretary of State may exercise those powers to give effect to the provisions of the Hague Convention. Section 17 was substituted by section 3 of the 1999 Act.
By virtue of section 16(1) of the 1999 Act any function of the Secretary of State under section 1 of that Act or section 17 of the 1976 Act is exercisable only after consultation with the National Assembly for Wales.
