Whereas the review body appointed under section 1(1) of the School Teachers' Pay and Conditions Act 1991(1) (“the Act”) have made a report following the reference to them of certain matters;
And whereas the Secretary of State has consulted, in accordance with section 2(1) of the Act(2), such associations of local education authorities, such bodies representing the interests of governors of foundation, voluntary, and foundation special schools and such bodies representing school teachers as appeared to her to be concerned;
Now, therefore the Secretary of State, in exercise of the powers conferred by sections 2(1), (3) and (4) and 5(4) of the Act(3) hereby makes the following order:
1. This Order may be cited as the Education (School Teachers' Pay and Conditions) Order 2002 and shall come into force on 1st April 2002.
2. This Order applies to school teachers (as defined in section 5(1) and (2) of the Act(4)) in England and Wales.
3. The School Teachers' Pay and Conditions Document 2001(5) shall be amended with effect from 1st April 2002 as follows:
(a)in paragraph 3.3(b) for “19” there shall be substituted “15” and for “18” there shall be substituted “16”;
(b)in paragraph 4.1 for the words “From 1st April 2001” there shall be substituted the words “From 1st April 2002”;
(c)in paragraph 4.2 for the words “From 1st April 2001” there shall be substituted the words “From 1st April 2002”;
(d)in paragraph 4.3 for the words “From 1st April 2001” there shall be substituted the words “From 1st April 2002”;
(e)the following table shall be substituted for the table in paragraph 4.5—

“36.1 A teacher serving in the London Area shall receive a London Area allowance of:
(a)if he is serving in the Inner London Area, £3,105 per annum from 1st April 2002;
(b)if he is serving in the Outer London Area, £2,043 per annum from 1st April 2002; and
(c)if he is serving in the Fringe Area, £792 per annum from 1st April 2002.”;
(aa)in paragraph 39.5(c) for “22” there shall be substituted “23”;
(bb)after paragraph 46A there shall be inserted the following paragraph:
46B.1 The relevant body in relation to a teacher liable to pay a fee in respect of their registration with the General Teaching Council for England or the General Teaching Council for Wales shall, in respect of the fee due in the year 1st April 2002 to 31st March 2003, determine that a single payment of £33 shall be paid to that teacher.
46B.2 Before making a determination under paragraph 46B.1 the relevant body shall take reasonable steps to satisfy itself that the teacher has not received a payment under paragraph 46B.1 from any other relevant body.
46B.3 A local education authority shall upon request take reasonable steps to provide a relevant body with information as to whether or not a teacher who is or has been employed at a school or as an unattached teacher within that authority has received a payment under paragraph 46B.1.
46B.4 Paragraph 40 of this Document shall not apply to this allowance.”; and
(cc)in paragraph 47.1 after “advanced skills teachers” there shall be inserted “and fast track teachers”.

This Order amends the School Teachers' Pay and Conditions Document 2001 (the Document) by uprating the amounts of salary and certain allowances. The following are increased—
(a)the leadership group pay spine set out in paragraph 4.5 of the Document;
(b)the head teacher groups' pay ranges set out in paragraph 6.3 of the Document;
(c)the pay scale for classroom teachers set out at paragraph 15.3 of the Document;
(d)the pay scale for post-threshold teachers set out at paragraph 17.5 of the Document;
(e)the management allowances set out at paragraph 22.1 of the Document;
(f)the recruitment and retention allowances set out at paragraph 23.1 of the Document;
(g)the special educational needs allowance set out at paragraph 24.1 of the Document;
(h)the pay spine for advanced skills teachers set out at paragraph 27.1 of the Document;
(i)the pay scale for unqualified teachers set out at paragraph 31.1 of the Document; and
(j)the London area allowances set out at paragraph 36.1 of the Document.
The increases take effect from 1st April 2002.
The Order also removes the requirement which was due to take effect from 1st April 2002 that applicants for a certificate of eligibility for appointment as an advanced skills teacher must have passed the threshold.
The Order makes provision for a freestanding allowance to be paid to all teachers who are required to pay a fee in respect of registration with the General Teaching Council for England or the General Teaching Council for Wales.
The Order corrects some minor typographical errors in the Document.
The Document is published by Her Majesty’s Stationery Office and is obtainable from book shops of The Stationery Office Limited and through booksellers.
Section 2(1) is amended by paragraphs 24 and 26(a) of Schedule 30 to the School Standards and Framework Act 1998 (c. 31).
Section 2(3) and (4) is amended by paragraphs 24 and 26(c) and (d) of Schedule 30 to the School Standards and Framework Act 1998.
The definition of “school teacher” in section 5(1) is amended by paragraphs 24 and 28(2)(a) of Schedule 30 to the School Standards and Framework Act 1998.
