The Abolition of the Central Council for Education and Training in Social Work Order 2002

Present,

The Queen’s Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred upon Her by sections 70(2) to (4) and 118(4) to (6) of the Care Standards Act 2000(1) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of the Privy Council, to order, and it is hereby ordered, as follows:

Citation, interpretation and commencement

1.—(1) This Order may be cited as the Abolition of the Central Council for Education and Training in Social Work Order 2002.

(2) In this Order, “the Act” means the Care Standards Act 2000.

(3) This Order shall come into force on 1st April 2002.

Repeal of provisions relating to the Central Council for Education and Training in Social Work

2.  The following provisions are hereby repealed—

(a)section 10 of and Schedule 3 to the Health and Social Services and Social Security Adjudications Act 1983(2);

(b)the reference to the Central Council for Education and Training in Social Work in paragraph 11 of Schedule 5 to the Government of Wales Act 1998(3); and

(c)the reference to the Central Council for Education and Training in Social Work (UK) in Part VI of Schedule 1 to the Freedom of Information Act 2000(4).

Transfer of rights and liabilities

3.—(1) All property belonging to the Central Council for Education and Training in Social Work at the coming into force of this Order is hereby transferred to the Secretary of State.

(2) Any outstanding liabilities to which the Central Council for Education and Training in Social Work is subject at the coming into force of this Order which relate to functions exercisable by—

(a)the General Social Care Council established in accordance with section 54(1) of the Act, transfer to and vest in the General Social Care Council;

(b)the Care Council for Wales established in accordance with section 54(1) of the Act, transfer to and vest in the Care Council for Wales;

(c)the Scottish Social Services Council established in accordance with section 43 of the Regulation of Care (Scotland) Act 2001(5), transfer to and vest in the Scottish Social Services Council; or

(d)the Northern Ireland Council established under section 1 of the Health and Personal Social Services Act (Northern Ireland) 2001(6), transfer to and vest in the Northern Ireland Council.

(3) Any outstanding liabilities to which the Central Council for Education and Training in Social Work is subject at the coming into force of this Order other than those referred to in paragraph (2) above transfer to and vest in the Secretary of State.

Revocation

4.  Article 7 of the Central Council for Education and Training in Social Work (Transfer Scheme) Order 2001(7) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order repeals provisions in the Health and Social Services and Social Security Adjudications Act 1983 relating to the Central Council for Training and Education in Social Work (“CCETSW”). The functions of the CCETSW are abolished in relation to England and Wales by section 70 of the Care Standards Act 2000; in relation to Northern Ireland by section 17 of the Health and Personal Social Services Act (Northern Ireland) 2001 and in relation to Scotland under section 67 of the Regulation of Care (Scotland) Act 2001.

CCETSW’s assets and liabilities were transferred under the Central Council for Education and Training in Social Work (Transfer Scheme) Order 2001 (S.I. 2001/2561), subject to certain savings. Those savings provisions are now revoked (article 4) and any remaining assets and liabilities of CCETSW are transferred to the Secretary of State or the successor bodies established under the above-mentioned Acts.
