Whereas Brunei and the territory then known as Newfoundland and now known as Newfoundland and Labrador were designated as reciprocating countries under the Maintenance Orders (Facilities for Enforcement) Act 1920(1):

And whereas that Country and territory are by the Reciprocal Enforcement of Maintenance Orders (Designation of Reciprocating Countries) Order 2002(2) designated reciprocating countries for the purposes of the Maintenance Orders (Reciprocal Enforcement) Act 1972(3) and are no longer designated for the purposes of the said 1920 Act:

Now, therefore, Her Majesty, in exercise of the powers conferred upon Her by section 19 of the Maintenance Orders Act 1958(4), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1.  This Order may be cited as the Maintenance Orders (Facilities for Enforcement) (Revocation) Order 2002 and shall come into force on 28th May 2002, immediately after the coming into force of the Reciprocal Enforcement of Maintenance Orders (Designation of Reciprocating Countries) Order 2002.

2.  “Brunei” and “Newfoundland and” shall be omitted from the First Schedule to the Maintenance Orders (Facilities for Enforcement) Order 1959(5).

Explanatory Note

(This note is not part of the Order)

This Order revokes the Maintenance Orders (Facilities for Enforcement) Order 1959 insofar as it extends the Maintenance Orders (Facilities for Enforcement) Act 1920 to Brunei and the territory of Newfoundland. This Country and that territory now known as Newfoundland and Labrador are designated as reciprocating countries for the purposes of Part I of the Maintenance Orders (Reciprocal Enforcement) Act 1972 by the Reciprocal Enforcement of Maintenance Orders (Designation of Reciprocating Countries) Order 2002 (S.I. 2002/788) which comes into force on the same date as this Order.
