Independent fostering agencies—duty to secure welfare

11.  The registered person in respect of an independent fostering agency(1) shall ensure that—

(a)the welfare of children placed or to be placed with foster parents is safeguarded and promoted at all times; and

(b)before making any decision affecting a child placed or to be placed with foster parents due consideration is given to—

(i)the child’s wishes and feelings in the light of his age and understanding; and

(ii)his religious persuasion, racial origin and cultural and linguistic background.

Similar duties already apply to a fostering agency within the meaning of section 4(4)(b) of the 2000 Act by virtue of section 61 of the Children Act 1989, and to a local authority by virtue of section 22 of the Children Act.
