(This note is not part of the Regulations)
These Regulations, which are made under sections 6, 7 and 138 of the School Standards and Framework Act 1998, amend the Education Development Plans (England) Regulations 2001 (“the 2001 Regulations”).
Regulation 2 corrects a drafting error in the 2001 Regulations.
The remainder of the amendments apply in relation to the areas of five local education authorities in England, set out in regulation 3, namely Birmingham, Blackburn with Darwen, Derbyshire, Stockton-on-Tees and Warwickshire.
These local education authorities are taking part in a pilot project for the rationalisation of education plans within the framework of their Local Public Service Agreements. Within the pilot project it is appropriate that the 2001 Regulations should be amended in relation to the areas of these local education authorities.
Regulation 4 amends regulation 5 of the 2001 Regulations so that the five local education authorities must submit the second education development plan to the Secretary of State by 30th April 2002.
Regulation 5 omits the following regulations of the 2001 Regulations in their application to the five local education authorities: regulations 11 (Information used by a local education authority in the setting of targets), 15 (Description of the local education authority’s proposed activities) and 16 (Resources). Regulation 6 makes an amendment consequential on those made by regulation 5.
Regulation 7 amends regulation 18 of the 2001 Regulations to reduce the information required of the five local education authorities in respect of the consultation they have undertaken in the preparation of the second education development plan.
