Coming into force

The Secretary of State for Transport, being a Minister designated1 for the purposes of section 2(2) of the European Communities Act 19722 for the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme, in exercise of the powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Motor Vehicles (EC Type Approval) (Amendment) (No. 2) Regulations 2002 and shall come into force on 27th November 2002.

Amendments to Schedule 12

The Table in Schedule 1 to the Motor Vehicles (EC Type Approval) Regulations 19983 shall be further amended by the insertion in the columns specified of the entries specified below.

These Regulations amend the Motor Vehicles (EC Type Approval) Regulations 1998 (“the 1998 Regulations”).

Directive 71/320/EEC4 relating to the technical specification for braking devices in certain motor vehicles (a “separate Directive” specified in Schedule 1 to the 1998 Regulations) has been amended by Directive 2002/78/EC. Regulation 2 inserts a reference to Directive 2002/78/EC at the appropriate place in the table in Schedule 1 to the 1998 Regulations, thereby implementing that Directive for the purposes of EC type approval procedures.

In line with the 1998 Regulations, the use of the symbol * denotes that the Directive specified is a Commission Directive.

This Explanatory Note incorporates the Transposition Note that would otherwise have been provided separately.
