The First Secretary of State, in exercise of the powers conferred on him by sections 173(10), 174(4) and 175(1) of the Town and Country Planning Act 1990(1) and sections 39(4), 40(1), 42(5) and 91(1)(a) of the Planning (Listed Buildings and Conservation Areas) Act 1990(2) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

1990 c. 8; the functions of the Secretary of State under sections 173(10), 174(4) and 175(1) were, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2 of and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672; see entry in Schedule 1 to the Town and Country Planning Act 1990 (c. 8). Section 173(10) is substituted by section 5(1) of the Planning and Compensation Act 1991 (c. 34); see section 336(1) of the 1990 Act for the definition of “prescribed”.
