The Secretary of State, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community, acting in exercise of the powers conferred on him by that section, makes the following Regulations:
1. These Regulations may be cited as the Products of Animal Origin (Third Country Imports) (England) (Amendment) (No. 2) Regulations 2002 and shall come into force on 11th October 2002.
2. Schedule 2 to the Products of Animal Origin (Third Country Imports) (England) Regulations 2002(3) (import conditions) is amended in accordance with this regulation—
(a)for the entry in section C of Part I (protective measures–all products) there is substituted the following entry—
Commission Decision 2002/69/EC (OJ No. L30, 31.1.2002, p.50), as amended by Commission Decision 2002/441/EC (OJ No. L151, 11.6.2002, p.16), Commission Decision 2002/573/EC (OJ No. L181, 11.7.2002, p.21) and Commission Decision 2002/768/EC (OJ No. L260, 28.9.2002, p.31).”; and
(b)in section H of Part IX (protective measures–fishery products)—
(i)for paragraph 2 there is substituted—
2. Commission Decision 2001/699/EC (OJ No. L251, 20.9.2001, p.11) as amended by Commission Decision 2002/770/EC (OJ No. L265, 3.10.2002, p.16).”, and
(ii)paragraphs 5 and 7 are omitted.

1. These Regulations amend section C of Part I and section H of Part IX of Schedule 2 to the Products of Animal Origin (Third Country Imports) (England) Regulations 2002 (S.I. 2002/1227, as amended) in order to give effect in England to the following Commission Decisions—
Commission Decision 2002/768/EC amending Decision 2002/69/EC concerning certain protective measures with regard to the products of animal origin imported from China (OJ No. L260, 28.9.2002, p.31);
Commission Decision 2002/770/EC amending Commission Decision 2001/699/EC and repealing Commission Decision 2002/250/EC to revoke the protective measures with regard to the fishery and aquaculture products imported from Vietnam (OJ No. L265, 3.10.2002, p.16);
Commission Decision 2002/771/EC repealing Decision 2002/62/EC concerning protective measures with regard to the fishery and aquaculture products imported from Pakistan (OJ No. L265, 3.10.2002, p.18).
2. The Products of Animal Origin (Third Country Imports) (England) Regulations 2002 implement for England Council Directive 97/78/EC laying down the principles governing the organisation of veterinary checks on products entering the Community from third countries (OJ No. L24, 30.1.98, p.9).
3. The products to which S.I. 2002/1227 applies are defined in regulation 2(1) of and Schedule 3 to that instrument.
4. Schedule 2 to S.I. 2002/1227 lays down the conditions, by reference to the Community legislation listed in it, for the import of those products into England from third countries.
5. No regulatory impact assessment has been prepared in relation to these Regulations.
