The Secretary of State for Transport, Local Government and the Regions makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980 (A40 only)(1) and now vested in him (2) and of all other powers enabling him in that behalf:

1.  This Order may be cited as the A40 London to Fishguard Trunk Road (M40 Junction 8 to A44 Wolvercote Roundabout) (Detrunking) Order 2002, and shall come into force on 30 March 2002.

2.  In this Order—

(i) “principal” as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State; and

(ii) “the trunk road” means the A40 London to Fishguard Trunk Road (A40)

3.  The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a principal road from the date on which the Secretary of State notifies Oxfordshire County Council that they will become the highway authority responsible for that length of road.

THE SCHEDULE LENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD

The length of the trunk road ceasing to be a trunk road is situated between the M40 at Junction 8 and the A44 at Wolvercote Roundabout, including:

• the A40/A44 Wolvercote Roundabout;

• the A40/A4165 Cutteslowe Roundabout;

• the A40/A4142 Headington Roundabout;

• the M40/A418 northbound exit and entry link road;

• the A40/A418 southbound exit link road;

all parallel cycle lanes and lay-bys;

• and is shown by broad black dashes on the plans numbered A40-75363/4/A40/001-027, marked “The A40 London to Fishguard Trunk Road (M40 Junction 8 to A44 Wolvercote Roundabout) (Detrunking) Order 2002”, signed by authority of the Secretary of State for Transport, Local Government and the Regions, DTLR Deposited Document Service, Ashdown House, Sedlescombe Road North, St Leonards on Sea, Hastings, East Sussex TN37 7GA.
