Whereas:
(1) pursuant to section 71C(5) of the Race Relations Act 1976(1) (“the 1976 Act”) the Secretary of State, on 17th April 2002, laid before Parliament a draft transmitted to him by the Commission for Racial Equality (“the Commission”) of a code of practice containing such practical guidance as the Commission think fit in relation to the performance by persons of duties imposed on them by virtue of subsections (1) and (2) of section 71 of the 1976 Act (“the code”); and
(2) neither House of Parliament has resolved during the period referred to in section 71C(6) of the 1976 Act that no further proceedings be taken on the draft code;
Now, therefore, in exercise of the powers conferred upon him by section 71C(8) of the 1976 Act, and after consulting the Scottish Ministers and the National Assembly for Wales, the Secretary of State makes the following Order:
