Whereas it appears to the Secretary of State that the full-time equivalent enrolment number of the institution conducted by the Birmingham College of Food, Tourism and Creative Studies(1) for courses of higher education exceeds 55 per cent. of its total full-time equivalent enrolment number;
Now therefore the Secretary of State for Education and Skills, in exercise of the powers conferred by section 122A of the Education Reform Act 1988(2) hereby makes the following Order:
1. This Order may be cited as the Education (Birmingham College of Food, Tourism and Creative Studies) (Transfer to the Higher Education Sector) Order 2002 and shall come into force on 1st August 2002.
2. On the date on which this Order comes into force the Birmingham College of Food, Tourism and Creative Studies shall cease to be a further education corporation and shall become a higher education corporation.

This Order makes provision for the transfer of the Birmingham College of Food, Tourism and Creative Studies to the higher education sector. On 1st August 2002 that corporation becomes a higher education corporation.
Incorporated under section 15 of the Further and Higher Education Act 1992 (c. 13) by S.I. 1992/2097.
1988 c. 40; section 122A was inserted by section 74 of the Further and Higher Education Act 1992.
