Coming into force

The Lord Chancellor, in exercise of the powers conferred upon him by sections 53(8) and 120(3) of, and paragraph 15(2) and (3) of Schedule 19 to, the Courts and Legal Services Act 19901, hereby makes the following Order:

Citation, commencement and interpretation1

This Order may be cited as the Council for Licensed Conveyancers (Disciplinary Powers) Order 2001 and shall come into force on 1st February 2001.

In this Order “the Act” means the Courts and Legal Services Act 1990.

Date for transfer of jurisdiction under the Act2

The date specified for the purpose of paragraph 15(2) of Schedule 19 to the Act shall be 1st February 2001.

Transitional provision3

The Council for Licensed Conveyancers shall have the power to decide any case being considered under any of the provisions set out in paragraph 15(2)(a) or (b) of Schedule 19 to the Act immediately before 1st February 2001.

Paragraph 15(2) of Schedule 19 to the Courts and Legal Services Act 1990 provides that the Lord Chancellor may specify a date on which the disciplinary powers specified in that sub-paragraph become exercisable by the Council for Licensed Conveyancers. Article 2 of this Order specifies 1st February 2001 as the date for this purpose.
