Explanatory Note

(This note is not part of the Order)

This Order makes provision for the transfer to the Electoral Commission of all the functions of the Local Government Commission for England (“the LGCE”) and of the functions of the Secretary of State in relation to local government and London Assembly electoral changes.

Article 2 transfers all the functions of the LGCE to the Electoral Commission on 1st April 2002.

Article 3 transfers specified functions of the Secretary of State in relation to electoral matters to the Electoral Commission on the same date.

Article 4 makes provision in relation to the LGCE’s final accounts and article 5 provides for the transfer of the LGCE’s staff to the Electoral Commission.

Article 6 provides for continuity in the exercise of functions and article 7 deals with the future handling of complaints of maladministration made against the LGCE.

Article 8 and Schedule 1 make amendments to Part II of the Local Government Act 1992.

Article 9 and Schedule 2 make amendments to other enactments.

The general effect of these modifications is to substitute the Electoral Commission for the Secretary of State in relation to electoral matters, to provide for reviews formerly carried out by the English Commission to be carried out by the Boundary Committee for England and to enable the Electoral Commission to implement recommendations of that Committee on electoral matters by Order.
