278.—(1) Section 15B(1) of the Theft Act 1968 (obtaining a money transfer by deception: interpretation) is amended as follows.
(2) In subsection (4), the words after paragraph (b) are repealed.
(3) After that subsection insert—
“(4A) References in subsection (4) to a deposit must be read with—
(a)section 22 of the Financial Services and Markets Act 2000;
(b)any relevant order under that section; and
(c)Schedule 2 to that Act,
but any restriction on the meaning of deposit which arises from the identity of the person making it is to be disregarded.”.
Section 15B was inserted by the Theft (Amendment) Act 1996 (c. 62) s. 1(1).
