1. These Regulations may be cited as the Financial Services and Markets Act 2000 (Law Applicable to Contracts of Insurance) (Amendment) Regulations 2001 and come into force on 1st December 2001.
2. In regulation 3 of the Financial Services and Markets Act 2000 (Law Applicable to Contracts of Insurance) Regulations 2001(3), omit the word “and” at the end of paragraph (2)(c)(ii) and, for paragraph (2)(c)(iii), substitute—
“(iii)regulation 7(1) applies as if for the words “the 1990 Act is to be treated as applying”, there were substituted “a court in any part of the United Kingdom must apply the general rules of private international law of that part of the United Kingdom concerning contractual obligations”; and
(iv)regulation 7(2) and (3) apply as if for the words “the 1990 Act is to be treated as applying” in each case, there were substituted the words “the general rules of private international law of that part of the United Kingdom concerning contractual obligations apply”.”.
