The Care Standards Act 2000 (Commencement No. 8) (England) Order 2001

The Secretary of State for Health, in exercise of the powers conferred by section 122 of the Care Standards Act 2000(1) and all other powers enabling him in that behalf, hereby makes the following Order:

Citation, interpretation and extent

1.—(1) This Order may be cited as the Care Standards Act 2000 (Commencement No. 8) (England) Order 2001.

(2) In this Order, “the Act” means the Care Standards Act 2000.

(3) This Order extends to England only.

Appointed day

2.  4th October 2001 is the day appointed for the coming into force of—

(a)section 112 of the Act (charges for local authority welfare services);

(b)section 117(2) of, and Schedule 6 to, the Act (transitional provisions, savings and repeals), in so far as they relate to section 18(1) and (3) of the Chronically Sick and Disabled Persons Act 1970(2).

Explanatory Note

(This note is not part of the Order)

This Order brings into force certain provisions of the Care Standards Act 2000 (c. 14) (“the Act”) in relation to England only.

It brings into force on 4th October 2001 section 112 of the Act, which amends the Local Authority Social Services Act 1970 (“the 1970 Act”), so that the powers of local authorities to charge for certain non-residential services are to be treated as social services functions as defined in the 1970 Act.

It also brings into force on that day section 117(2) of, and Schedule 6 to, the Act, in so far as they repeal section 18(1) and (3) of the Chronically Sick and Disabled Persons Act 1970. Section 18(1) and (3) provides for local authorities to supply to the Secretary of State information as to residential accommodation which is provided under Part III of the National Assistance Act 1948 for persons under 65 and over 65 in the same premises.

The following provisions of the Care Standards Act 2000 have been brought into force—

(a)in relation to England (as well as Wales) by the Care Standards Act 2000 (Commencement No. 1) Order 2000 (S.I.2000/2544) (C.72); and

    Certain provisions of the Act have been brought into force, in relation to Wales only, by the following statutory instruments—

(1)

2000 c. 14. The powers are exercisable by the appropriate Minister. The appropriate Minister is defined in section 121(1), in relation to England, Scotland and Northern Ireland, as the Secretary of State, and in relation to Wales, as the National Assembly for Wales.
