Whereas the Secretary of State has received a proposal from the Learning and Skills Council for England, made in accordance with section 51 of the Further and Higher Education Act 1992(1) (“the Act”), for the establishment of a body corporate under section 16(1)(a) of the Act;
Now, therefore, in exercise of the powers conferred on her by sections 16(1) and 17 of the Act and for the purpose of giving effect to that proposal, the Secretary of State hereby makes the following Order:
1. This Order may be cited as the Brooke House Sixth Form College (Incorporation) Order 2001 and shall come into force on 15th October 2001 (“the commencement date”).
2. There shall be established as from the commencement date a body corporate called “Brooke House Sixth Form College”, for the purpose of establishing and conducting as from the operative date an educational institution of that name.
3. The operative date in relation to the further education corporation established by this Order shall be 2nd September 2002, and the corporation shall conduct Brooke House Sixth Form College from that date.

This Order establishes a further education corporation called Brooke House Sixth Form College under section 16(1) of the Further and Higher Education Act 1992 for the purpose of conducting the educational institution called by the same name. It appoints 2nd September 2002 as the operative date for the purposes of Part 1 of that Act.
