These Regulations are made under section 2(2) of the European Communities Act 1972 and make provision for the investigation of, and the making and enforcement of decisions in respect of, agreements or conduct on which it appears to the Director General of Fair Trading (“the Director”) the United Kingdom has a duty to rule under Article 84 of the Treaty. These Regulations revoke and replace the EC Competition Law (Articles 88 and 89) Enforcement Regulations 1996.

Notification for a decision in relation to agreements7

A party to an agreement who applies for the agreement to be examined under this regulation must—
a
notify the Director of the agreement; and
b
apply to him for a decision.

On an application under this regulation, the Director may make a decision as to whether the prohibition in Article 81(1) has been infringed.
3
If an agreement is notified to the Director under this regulation, the application may include a request for the agreement to which it relates to be granted an exemption.
